Terms of sale
1. Purpose
These terms and conditions of sale (the “Terms”) govern the sale of jewellery and straw marquetry creations offered on the shop of the ateliermayati.fr website (the “Shop”) to individual consumers. Any order placed on the Shop implies full acceptance of these Terms.
2. Seller
The products are sold by Stéphanie Deschodt, straw marquetry artisan,
trading as Atelier Mayati.
Atelier Mayati, 1440 route de Laplace, 32400 Verlus, Gers — France.
Company registration (SIRET): 811 907 534 00028.
VAT not applicable, art. 293 B of the French CGI.
Contact: contact@ateliermayati.fr.
3. Products
The products offered are handmade artisanal pieces of straw marquetry. As each piece is unique, slight variations in shade, pattern or dimensions compared with the photographs are inherent to their handcrafted nature and do not constitute a defect. The product photographs are not contractually binding as to colour nuances, which may vary depending on the screen.
Made-to-order creations are produced according to the choices communicated by the customer (base, colours, pattern) after the order. They are by nature personalised (see Article 8 on the right of withdrawal).
4. Prices
Prices are shown in euros (€), all taxes included, excluding delivery charges. Delivery charges are shown separately before the order is confirmed (see Article 7). Atelier Mayati reserves the right to change its prices at any time, it being understood that the applicable price is the one in force when the order is confirmed.
5. Orders
Orders are placed directly on the product page, via the payment button. The customer selects the delivery zone (France or Europe) and is then directed to the secure payment page. The sale is definitively concluded once payment is confirmed. A confirmation email summarising the order is sent to the customer.
6. Payment
Payment is made online, at the time of the order, by bank card through our secure payment provider Stripe. Payment data is transmitted in encrypted form and is never stored by Atelier Mayati. The order is only validated after the payment has been accepted.
7. Delivery
Products are shipped using the following methods and rates:
- France — Mondial Relay, home delivery: €4.99, indicative time 3 to 5 business days after dispatch.
- France — Colissimo, home delivery: €5.49, indicative time 48 hours after dispatch.
- Europe (European Union, Switzerland and United Kingdom) — Colissimo: €14.99, indicative time 5 days after dispatch.
Orders are dispatched as quickly as possible, within approximately 2 to 3 business days after payment confirmation (except made-to-order creations, whose production time is 1 to 4 weeks depending on the order volume). Delivery times are given for information only; a reasonable delay shall not give rise to cancellation or compensation. The risks relating to transport are transferred to the customer upon receipt of the parcel.
Should a parcel arrive damaged or a product be non-compliant on receipt, the customer is invited to report it as soon as possible to contact@ateliermayati.fr, attaching photographs where possible.
8. Right of withdrawal
In accordance with Articles L221-18 et seq. of the French Consumer Code, the individual customer has a period of fourteen (14) days from receipt of the product to exercise the right of withdrawal, without having to give a reason. To do so, simply inform Atelier Mayati by email at contact@ateliermayati.fr before the deadline expires.
The product must be returned in its original condition, complete and undamaged, to the following address: Atelier Mayati, 1440 route de Laplace, 32400 Verlus, France. Return costs are borne by the customer. Atelier Mayati refunds the price of the product (and the initial standard delivery charges) within fourteen (14) days of recovering the product or of proof of its dispatch.
Exception — made-to-order creations: in accordance with Article L221-28 3° of the French Consumer Code, the right of withdrawal does not apply to goods made to the customer’s specifications or clearly personalised. Made-to-order orders are therefore neither taken back nor refunded, except in the event of a lack of conformity.
9. Legal guarantees
Independently of any commercial warranty, the customer benefits from the legal guarantee of conformity (Articles L217-3 et seq. of the French Consumer Code) and the guarantee against hidden defects (Articles 1641 et seq. of the French Civil Code), allowing, where applicable, the replacement or refund of non-compliant or defective products. Any claim may be sent to contact@ateliermayati.fr.
10. Personal data
Data collected when placing an order is processed in accordance with our privacy policy.
11. Governing law
These Terms are governed by French law. In the event of a dispute, and after an attempt at an amicable resolution, the French courts shall have jurisdiction.
